Kazakhstan simplifies procedures of Custom Register of Intellectual Property Objects
Since January 01, 2018, submission of confirmed facts of infringement of intellectual property rights in any of the Eurasian Economic Union countries, became a prerequisite for granting a customs protection in Kazakhstan. The requirement limited rightowners from applying boarder measures.
The Law of the Republic of Kazakhstan "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Customs Regulation and Entrepreneurship" № 407-VI ЗРК from January 05, 2021 provides a simplified procedure for inclusion of intellectual property in the Customs register, namely by:
1. Exclusion of the paragraph on the requirement to provide a document confirming the fact of infringement of intellectual property rights in movement of goods across the customs border of the Eurasian Economic Union;
2. Implementing E-services for procedures of Customs Register on entering, extending, and excluding IP objects.
The Law comes into force on January 19, 2021.
