From Patent to Marketing Authorization
The Legalmax team provided full-cycle support to the client in protecting and commercializing a medical technology - from patenting innovative solutions to medical device registration and obtaining the necessary approvals for market entry (Marketing Authorization, MA).
Our colleagues, Lola Islamova and Asadbek Gafarov, implemented a comprehensive project for Agros International, focused on the legal protection and subsequent market launch of innovative solutions in the field of gastroenterology.
As part of the project, the team secured patent protection for several inventions within the jurisdiction. These included in vitro diagnostic technologies based on biomarker analysis, designed for the early detection of inflammatory bowel diseases, polyps, and oncological conditions.
The scope of work included the development of an optimal patenting strategy, fast-track prosecution support, and consistent management of applications through to the receipt of positive examination results.
However, the value of the project was not limited to obtaining patents.
The Legalmax team went beyond traditional IP support and ensured the next critical stage - the actual commercialization of the technology.
A patent alone does not grant access to the market. For a medical solution to be applied in practice, it must undergo regulatory procedures and obtain the necessary approvals for medical device registration.
This stage proved to be one of the most complex. In the context of regulatory uncertainty, procedural barriers, and specific enforcement practices, Legalmax specialists supported the medical device registration process and ensured the successful completion of all required stages.
As a result, the client obtained not only patent protection for its developments, but also a real opportunity to bring the product to market, apply the technology in practice, and expand its presence in the region.
